Important Court Ordered Notice

You have been sent a Notice in this lawsuit because the records of the Fujitsu 401(k) Plan indicate that you may be a Class Member.

If you fall within the definition of the Class, you have a right to know about the Settlement and about all of the options available to you before the Court decides whether to give its final approval to the Settlement. If the Court approves the Settlement, and after any objections and appeals are resolved, the Net Settlement Amount will be allocated among Class Members according to a Court-approved Plan of Allocation.

The class is defined as: All participants and beneficiaries of the Fujitsu Group Defined Contribution and 401(k) Plan at any time on or after June 30, 2010 through September 30, 2017 including any Beneficiary of a deceased person who was a Participant in the Plan at any time during the Class Period, and any Alternate Payees in the case of a person subject to a Qualified Domestic Relations Order who was a Participant in the Plan at any time during the Class Period.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT DEADLINE
Current Participants: If you received a notice indicating you are a current participant, you do not need to do anything to receive your share of the Net Settlement Amount.
Former Participants: If you received a notice indicating you are a former participant, you must mail in the Former Participant Claim Form postmarked on or before April 13, 2018. Former Participants must timely submit a valid Claim Form to be entitled to a share of the Net Settlement Amount. Deadline to Submit a Former Participant Claim Form: Postmarked on or before April 13, 2018
You May Object: Class members may write to the Court about why they don’t believe the settlement is fair. The Court will consider the objections in deciding whether to approve the settlement. Deadline to File Objection With the Court:
